These Terms and Conditions (“Terms”) govern your use of RedBirdHope.org (the “Site”) and related services offered by The Red Bird Foundation (“Red Bird”, “we”, “us”). By using the Site, you agree to these Terms.
Eligibility and accounts
You must provide accurate information when submitting forms or creating accounts (if applicable). If you create an account, you are responsible for maintaining the confidentiality of your login credentials.
Community requests and volunteer assistance
The Site may allow individuals to submit requests for help and allow volunteers (“Angels”) to view and respond to requests within their service area.
- Requests are reviewed and may be moderated. We may decline or remove requests at our discretion, including if we do not have volunteer coverage in a given area.
- Angels are volunteers. We do not guarantee that a request will be fulfilled, that a specific time frame will be met, or that any particular outcome will occur.
- You agree to provide truthful and respectful information. You may not use the Site to request or facilitate illegal activity, harassment, or unsafe behavior.
Donations
Donations are processed through third-party payment providers. Donation processing, refunds (if any), and transaction records may be governed by the payment provider’s policies.
Unless otherwise required by law, donations are generally nonrefundable. If a donation must be redirected due to changed circumstances, we will apply it in a manner consistent with our mission and any donor restrictions communicated to us in writing.
SMS and email communications
By providing a phone number and opting in, you consent to receive SMS messages related to Red Bird alerts and coordination. Message frequency varies. Message and data rates may apply. Reply STOP to opt out. Reply HELP for help.
Acceptable use
- Do not attempt to gain unauthorized access to the Site, other accounts, or private request information.
- Do not upload malicious code, spam, or content that violates applicable laws.
- Do not scrape, harvest, or collect personal information from the Site without permission.
Intellectual property
The Site content, branding, logos, and text are owned by Red Bird or used with permission, unless otherwise noted. You may not copy, reproduce, or distribute content from the Site without written permission, except as allowed by law.
Third-party links and services
The Site may contain links to third-party websites or services. We are not responsible for third-party content, products, services, or privacy practices.
Disclaimers
The Site and services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, Red Bird will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from or related to your use of the Site or services.

You agree to indemnify and hold harmless Red Bird and its volunteers, officers, and agents from any claims, liabilities, damages, and expenses arising from your use of the Site or your violation of these Terms.
Termination
We may suspend or terminate access to the Site at any time if we believe you have violated these Terms or if necessary to protect the community and the Site.
Governing law
These Terms are governed by the laws of the State of South Carolina, without regard to conflict of law principles.

Program description
Red Bird Foundation Alerts provides SMS notifications to volunteers (Angels) and other opted-in users about new community requests, volunteer coordination, and related operational updates.
Consent and opt-in
Users opt in by providing a mobile number on RedBirdHope.org and selecting SMS alerts in their profile or an alerts signup form. Consent is collected through the website with clear disclosure that the user will receive SMS alerts and can opt out at any time.
Message frequency
Message frequency varies based on activity (for example, new requests posted in your service area).

How do end-users consent to receive messages?
End users opt in on RedBirdHope.org by entering their mobile number and selecting SMS alerts (for example, in an Angel profile or alerts signup form). The form clearly discloses that the user will receive Red Bird Foundation Alerts via SMS, that message frequency varies, and that message and data rates may apply. Users can opt out at any time by replying STOP and can get help by replying HELP or contacting help@redbirdhope.org. We do not support opt-in via texting a keyword; opt-in is collected via the website.
